Der Kooperationspartner betreibt ein EMS-Studio, bei welchem jeder Kunde vor der Nutzung und auch bei jeder weiteren Nutzung eine individuelle Aufklärung, Beratung und Betreuung für das EMS-Training erhalten muss (vgl. NiSV-Verordnung). In Abweichung von Ziffer 2.1 der Kooperationsvereinbarung kann der Kooperationspartner daher auch von Mitgliedern Zahlungen auf Grundlage entsprechender Nutzungsvereinbarungen (Tageskarten oder Mitgliedsbeiträge) verlangen, wobei der Kooperationspartner jedoch den Mitgliedern für jede Trainingsteilnahme eine Rückvergütung auf ihre Zahlungen in Höhe von 12,00 € pro Nutzung erstatten wird.
